Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: At the workplace known as Dexter Fruit Corporation dba
Bravo Supermarket,
employees were using a Hobart Meat Saw incorrectly. The employees were not
trained in the
correct use of the blade guard, gauge plate and pusher plate. At the time
of the accident an
employee was cutting meat and the guard was not lowered so that the
cutting zone would only
be as high as necessary, and the push plate was not used. Among other
methods, one feasible
and acceptable abatement method to correct this hazard is provide training
to all employees in
the correct use of the guards and pusher plate, as outline in the Hobart
instruction and video.
