Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer does not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees. The employer
violated this standard on or about May 11, 2004 in that employees were
observed operating
powered industrial trucks without seat belts in the following instances:
(a)the Cat T120, Serial number Z55L0094 was not equipped with a seat belt,
exposing employees to the hazards of being struck by or crushed by the
vehicle.
(b)the Yale, Serial Number N593609 was not equipped with a seat belt,
exposing
employees to the hazards of being struck by or crushed by the vehicle.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to order and install a retro-fit seat belt from the manufacturer.
**Pursuant to 29 CFR 1903.19(d), the employer must provide documentation
that
this violation
has been abated within 10 calendar days after the abatement date.**nt
