Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of:
For the period of time up to and including 02 Apr 04, the employer did not
always assure that
the rig was rigged up in a safe manner prior to the commencement of well
operations. Well
servicing operations had begun without the proper number if guywires
attached and secured to
anchors. This condition allowed for the two (2) guywires that were
installed to be pulled from
the ground, becoming de-tensioned, which allowed for the derrick to move
noticeably when
tripping in/out of the hole. This condition exposed employees to the
hazards associated with the
potential collapse/failure of the derrick.
American Petroleum Institute Recommended Practice RP54 Paragraph 6.3.2
states that "Well
operations involving the rig shall not be commenced until the rig is
rigged up in a safe manner."
Among other means, one feasible and acceptable method to correct this
hazard would be
to install the correct number of guywires in accordance with the
manufacturers
recommendations or install guywires in accordance with the minimum
requirements as
set forth in American Petroleum Institute Recommended Practice API RP 4G
Second
Edition dated Oct 1998 Paragraphs 6.1-8 and Appendix A Fig A-1.6.ix

For the period of time up to and including 02 Apr 04, the employer did not
always
ensure that
ground anchors had been pull tested prior to the commencement of work.
Well servicing
operations had begun without the anchors' capacity being determined.
Movement of the anchors
in the ground from their original position was apparent, which allowed the
derrick to visibly
move while tripping in/out of the hole. This condition exposed employee's
of the employer and
other contractors working on site to the hazards associated to the tipping
over and/or collapse
of the derrick.
American Petroleum Institute Recommended Practice RP54 Paragraph 6.3.2
states that: "Well
Operations involving the rig  shall not  be commenced until the rig is
rigged up in a safe
manner."
Among other methods, one feasible and acceptable abatement method to
correct this hazard
would be to: verify the capacity of each anchor within 24 months prior to
commencing work in
accordance with the requirements as set forth in American Petroleum
Institute Recommended
Practice API RP 4G, Second Edition dated Oct 1998 Paragraphs 7.1 thru 7.8.

For the period of time up to and including 02 Apr 04, the employer did not
always install the
adequate number of clips on .500-.625 inch wire rope used for guy wires
from the derrick, and
the clips were not properly attached. This condition exposed employees and
other contractor
employees on site to the hazards and injuries related to the wire rope
coming free of the clips
and becoming a "whip" when under tension.
One feasible and acceptable means to correct this hazard would be to
assure that the adequate
number of wire rope clips are installed at the end of wire ropes in
accordance
with API RP 9B,
Paragraph 3.7.4.aph

for employee use
should the need arise. This condition exposed employees working above the
wellhead to the
hazards associated with fire.

correct this hazard is
to ensure that the Escape Device installed each time the rig is rigged
