Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized
hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being caught between the billet
transfer car and the
stationary billet cooling/exit table.
a)  Employees were allowed to work on, between and around the railroad
tracks on the
south end of the south cooling table without any means to protect them
from being caught
between or struck-by the steel billet transfer car.  The Quality Control
Lab Technician
would commonly mark the steel billets while standing at the corner where
the
cooling/exit table and the transfer car tracks intersect and it was also
an acceptable
practice for the Quality Control Lab Technician to walk on or between the
tracks when
the transfer car was in the billet yard to perform a visual inspection of
the steel billets.
These conditions exposed employees to struck-by/caught between hazards.
Among other methods, one feasible and acceptable method to correct this
hazard is to
install controls that would require that the employee continuously depress
the control
button to move the transfer car, which separates the point of operation
from the point of
contact.
