Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being crushed by a forklift.
a)  Employees were allowed to operate a CASE Model# 586D forklift without
the
required use of a seatbelt. This condition exposed employees to a
crushed-by hazard that
would result from an employee being ejected during tip over.
Among other methods one feasible and acceptable abatement method to
correct this
hazard would be to employ the use of the seat belts supplied by the
manufacturer as
outlined in ANSI B56.6-1992 Section 6.2 1(a) requiring the use of seat
belts.
