Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the recognized hazard of falling from the work
platform being held
aloft by a Skytrak Model 3050 Rough Terrain Forklift. On the eastern side
of the building;
employees were observed erecting red-iron while standing on the top rail
of the work platform
and sitting on the thirty six (36) inch high top rail of the work platform
while the forklift was
being moved; the operator of the lift manipulated the controls of the
forklift while standing on
the ground behind the machine; the operator left the lift and went to the
northern end of the
work-site, a distance of approximately one hundred (100) yards, while a
fellow employee was
elevated in the work platform. The work platform extended a total of fifty
eight (58) inches
beyond the wheelbase of the forklift (twenty nine (29) inches per side).
a)  One feasible method of correcting these hazards is to implement and
follow the
American Society of Mechanical Engineers (ASME) B56.6-2002 (Safety
Standard for
Rough Terrain Forklift Trucks) Section 5.15; Elevating Personnel: 5.15(u):
Personnel
are to maintain firm footing on platform floor unless secured by body belt
and lanyard.
Section 6.2; General: 6.2.2: Do not operate the rough terrain forklift, or
any of its
functions, from any place other than the designated operator's position.
6.2.11: Ensure
that the lift is not left unattended - the lift is considered to be left
unattended when the
operator is more that 25 feet away from the lift which remains in his
view. Section 8.24;
Platforms for Elevating Personnel: 8.24.1(b): Properly construct the work
platform
so
that it is no more than a total of twenty (20) inches (10 inches on each
side) wider than
the wheelbase of the lift. 8.24.1(f)(1-2): prominently indicate the
maximum workload of
the platform (including personnel and equipment) and the empty weight of
the platform.
