Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to

always ensure that
no smoking rules were either observed or enforced. This condition exposed
employees to the
hazards and injuries related to fire and explosion.
a)  According to American Petroleum Institute (API) Recommended Practice
54 (RP54),
Third Edition dated August 1999, Paragraphs 7.1.2 & 7.1.3, states that:
2)  "Smoking shall be prohibited at or in the vicinity of operations that
constitute a fire
hazard. Such location should be conspicuously posted with a sign "NO
SMOKING OR
OPEN FLAME" or equivalent."
3)  "Smoking shall be permitted only in areas designated for smoking"

correct this

recommendations:
4)  "Change rooms and other buildings where smoking is permitted should be
located in
areas designated safe for smoking."
5)  "Matches and all smoking equipment should be left in areas designated
for smoking."
6)  "No source of ignition should be permitted in an area where smoking is
prohibited,
unless it is first determined safe to do so by the supervisor in charge or
his designated
representative."
