a) Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to the recognized hazard of being crushed by the Gradall 544 D-10 rough terrain forklift in the event of a tip over. Among other methods, one feasible and acceptable method to correct this hazard is to ensure that the operator of rough terrain power industrial truck utilizes the seat belt provided by a manufacturer.
