Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of tipping a rough terrain forklift. a) One feasible method of correcting this hazard is to implement and follow the American Society of Mechanical Engineers (ASME) B56.6-2002 (Safety Standard for Rough Terrain Forklift Trucks) Section 6.2.11: Ensure that the lift is not left unattended - the lift is considered to be left unattended when the operator is more than twenty-five (25) feet away from the lift which remains in his view. Section 8.24; Platforms for elevating Personnel: 8.24.1(b): Properly construct the work platform so that it is no more that a total of twenty (20) inches (ten inches on each side) wider than the wheel base of the lift. 8.24.1(f)(1-2): prominently indicate the maximum workload of the platform (including personnel and equipment) and the empty weight of the platform. DISCLAIMERS: 1) You are not limited to the abatement methods suggested above. 2) The methods explained are general and may not be effective in all cases. 3) The employer is responsible for selecting and carrying out an appropriate method.
