Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck by a train at a rail
crossing in the yard:
Among other methods, one feasible and acceptable method to protect
employees from
being struck by a train is for the employer to comply with Recommended
Practices For
Railroad-Highway Grade Crossing Warning Systems D8. 1-1974 (Supersedes
D6.1-1967)
"Obedience To Signal Indicating Approach Of Train."
a)  Whenever any person driving a vehicle approaches a railroad grade
crossing under
any of the circumstances stated in this section, the driver of such
vehicle shall stop within
50 feet but not less than 15 feet from the nearest rail of such railroad
and shall not
proceed until he can do so safely.  The foregoing requirements shall apply
when:
1. A clearly visible electric or mechanical signal device gives
warning of the immediate approach of a railroad train;
2. A crossing gate is lowered or when a human flagman gives or
continues to give a signal of the approach or passage of a train;
3. A railroad train approaching within approximately 1,500 feet of
a railroad crossing emits a signal audible from such distance and
such crossing, is an immediate hazard;
4. An approaching railroad train is plainly visible and is in
hazardous proximity to such crossing.

employees were exposed to the hazard of being crushed by a Nissan Powered
Industrial Truck
in the event of a roll over.
Among other methods, one feasible and acceptable method to correct this
hazard would
be to provide and require that the operator of the Powered Industrial
Truck use the
restraint device.
