Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which was free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck, crushed or pinned by falling automobiles
while working with an
automotive lift with defects that had not been properly inspected,
maintained, repaired or taken
out of service.
A)On or about 9/18/05: At Worksite
The employer failed to perform and document regular inspections of and
implement a
comprehensive maintenance/ repair program for Benwil Automotive lift
(Serial #B8907056 and
#B8907879). Benwill Lift #B8907056 was used with the following defects:
the lift chain was
excessively rusted, the carriage safety lock handle was completely broken
off, a lift adapter was
missing and lift adapter pads were missing.
AMONG OTHER METHODS, FEASIBLE METHODS OF ABATEMENT INCLUDE:
1) Develop methods for conducting and documenting periodic inspections of
all lifts in
accordance with recommendations of the lift manufacturer in order to
ensure reliability and allow
for the safe operation of the lifts.
2) Develop a comprehensive maintenance program in accordance with the lift
manufacturer's
schedule of maintenance to ensure that the lifts are maintained in safe
operating condition.
3) Perform daily safety checks of lifts to detect any defects that may
interfere with the safe
operation of the lifts at the start of the day, prior to usage.
4) Ensure that any lifts discovered to be in need of repair is removed
from service and tagged
"Do Not Use".
5) Ensure that all maintenance and needed repairs are performed by
qualified personnel.
