Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck-by a storm drainage
pipe rolling off
the top rails of the scissor lift.

An employee was hoisting a storm drainage pipe, the pipe was placed on 2 -
2 x 4's that
were on the top rails of the JLG Industries Inc. Model 3369 Electric
scissor lift.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to:
Follow the Operators & Safety Service & Maintenance Illustrated Parts
Manual.
It states:"
Do not carry materials directly on platform railing unless approved by
JLG." The employer
must ensure that these procedures are followed.
