Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a tip over hazard. a).On 10/31/07 on 115th Ave bet. 224th St & 225th St. Cambria Heights, NY An employee was backing off a Case 590 Super M backhoe from a trailer bed. He was not wearing a seat belt. As the machine began to fall off the side of the trailer bed the driver tried to jump clear of the falling backhoe. He was struck by the overhead enclosure. One feasible and acceptable method to correct this hazard is to: Follow the Case Oporator's Manual Loader Backhoe that states "Before starting each day, adjust the position of the seat for the most comfort and fasten the seat belt. Be sure that you are able to push the brake pedals all the way down while sitting with your seat belt fastened". The employer must ensure and enfore the company's Loss Control Program Policy. Loss Control Program Policy states that all drivers must comply with the Federal Motor Carrier Safety Regulations. The regulations required every truck and truck tractor must have a seat belt and the driver must be fastened to the seat belt before operating the machine. WRITTEN ABATEMENT CERTIFICATION IS REQUIRED.
