Section 5 (a) (1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being struck-by or crushed by
wheel pay loaders
and other recyclable materials collection and transportation equipment:
a) Workplace, Demolition Building & Immediate Vicinity - Nightshift
employees who
traverse the transportation & collection equipment traffic lanes, under
low light conditions,
are in danger of being struck by a wheel loader; on or about 01/26/07.
ABATEMENT NOTES:
Among other methods, one feasible method to reduce this hazard is to:
Follow the American National Standard, ANSI Z245.1 1999 and Caterpillar
Operation &
Maintenance Manual 970F Wheel Loader specifically:
a. Supply the appropriate work lighting for operations during the
hours of darkness. (ANSI Z245.1-1999 Page 19, 6.1.7.1)
b. Make sure all "Wheel Loader" lights are working properly;
Report any needed repairs noted during operation, (headlights) -

c. Provide instructions and training in safe methods of work to
employees before assigning them to a task and to the
surrounding hazards (ANSI- Section 9.3.1)
Note:  In addition to abatement certification, the employer is required to
submit
abatement documentation for this item in accordance with 29 CFR 1903.19.
