Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the unattended forklift in the event of unexpected movement: (a)At 4810 Skyland Blvd. East - Southside - On or about 04/22/04, the Pettibone 88- Extendo Rough Terrain Forklift was left unattended, exposing employees in the area to the injury of being struck by the equipment in the event of unexpected movement. Among other methods, one feasible and acceptable method to correct this hazard is to operate the equipment in accordance with the operator safety rules and practices outlined in ANSI B56.6- 1992, Section 6.2.11n
