Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck-by and against the buggies:
(a)Converted automobile trucks and vans into Buggies - On or about
04/28/2004,
operators and other employees were exposed to being struck-by and against
the
buggies in that the buggies were not equipped with devices to restrict the
top
operating speed; some vehicles are not equipped with seat belts and
drivers are
not required to wear seat belts; the passenger position with no seating
and no seat
belt do not provide protection in the event of an accident; there was not
an
adequate training program to ensure operators are competent to operate the
buggies safely.
Among other methods, one feasible and acceptable method to correct this
hazard
is to install devices to restrict the top operating speed of the vehicles,
install seat
belts on all vehicles and require their use, cease allowing riders as
passengers on
the buggies, or design a riding/passenger location with proper seat, seat
belt,
and
one that provides adequate frontal and side protection; establish and
implement
a systematic approach that incorporates enforcement and periodic
evaluation to
ensure that operators are competent to operate the vehicles safely and are
provided the necessary practical training to do so.
