Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of a crushing injury when supporting
vertical stacks of
stone slabs by hand:
a) On or about May 12, 2004, PNR of Pueblo dba The Tile House, did not
ensure that
employees were protected from crushing hazards while unloading granite
slabs.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is as follows:
1) Institute and enforce a policy in which employees are prohibited from
standing in the
danger zone of unstable and/or hand supported granite slabs. This could be
accomplished by
requiring employees to stand at each end of the verical slabs and support
the stack by holding
a brace or board between them.
