Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck or crushed when working under automobiles supported by automotive lifts: 1) On August 31, 2004, and at prior times, employees were exposed to the hazard of being struck by a falling automobile while working under the inground hydraulic lifts. None of the inground lifts were equipped with an automatic mechanical device to hold the lift in the fully extended position. 2) On August 31, 2004, and at prior times, employees were exposed to the hazard of being struck by a falling automobile while working under a Benwil lift located at the northeast corner of the shop that did not have functioning stops for the telescoping arms. 3) On August 31, 2004, and at prior times, employees were exposed to the hazard of being struck by a falling automobile while working under Benwil lifts located throughout the shop that did not have functioning swing arm restraints. Among other methods, the following are feasible and acceptable methods to correct these hazardous conditions: 1) Install a retrofit automatic mechanical safety device with a safety factor of 3 on the inground lifts, as referenced in ANSI/ALI B153.1. 2) Ensure that the inspection points listed in section 5.6 of ANSI/ALI ALOIM-2000, are addressed during periodic lift inspections, and ensure that repairs are conducted as necessary. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement-Certification Letter").-Certification
