Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees, in that, employees working with methscopolamine nitrate (MSN) experienced adverse symptoms of overexposure: a). On or about August 16, 2006, and at times prior, the employer did not take adequate steps to protect employees experiencing symptoms of exposure while working with MSN. Employees have reported the following symptoms of exposure to MSN over a time period of 12/28/05 to 10/19/06: 1. Dilated pupils 2. Itchy, redness, burning, and scratchiness of the eyes. 3. Light-headedness and nausea. Among other methods, some feasible and acceptable abatement methods are as follows: a) Develop and implement a pharmaceutical active ingredient exposure control plan including the engineering controls, administrative controls, work practice controls, and personal protective equipment. b) Install local exhaust ventilation at locations were employees weigh, mix, transfer, and manufacture pharmaceutical tablets. c) Ensure employees are provided clean protective clothing on a frequent basis. d) Develop a medical surveillance program consisting of employee symptom surveys, which could help identify employees experiencing adverse symptoms of overexposure.
