Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees where
employees were exposed to the hazard of flash fire and explosion from
magensium dust(s):
a)  On December 22, 2004, and at times prior, employees involved in the
manufacture of
magnesium parts were exposed to injuries, in that:
1. Magnesium dust was not collected by means of a suitable hood or
enclosure at each
location where sanding of magnesium parts was taking place.
2. Where employees were sanding magnesium parts hoods were not connected
to a
wet type collector, or a cyclone collector, equipped with blowers located
outside the
structure or building and in a safe area.
3. Employees involved in sanding magnesium parts were not following the
appropriate safety precautions or wearing the appropriate personal
protective
equipment (e.g. clothing was not flame resistant).
Among other methods, one feasible and acceptable abatement method is to:
1. Install a wet or dry dust collection system as outline and identified
in Chapter 4-2,
NFPA 480, 1998 Edition;
2. Follow cleaning instructions outlined by Chapter 4 and Chapter 7, NFPA
480,
1998 Edition.
3. Institute the Fire Prevention and Fire Protection guidelines in Chapter
9, NFPA
480, 1998 Edition.
