Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being struck by vehicular traffic while working near a roadway: a)The employer failed to ensure the the employees working near a roadway were protected from vehicular traffic, in that a high visiblity vest was not worn by the landscapers. The employees were tasked to perform weeding operations along a busy roadway, including weeding on a landscaped island. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
