Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of tipping the aerial lift in which they were
working:
Location: 44 Potter Ave.
On or about: 7/20/04
a) Two employees were bolting steel from a 110HX JLG aerial lift. The
axles were not extended
thus the employees were exposed to the hazard of tipping the aerial lift.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THE HAZARD IS TO:
1. Train employees in the safe operating procedures to follow while
operating the 110HX JLG
aerial lift as stipulated in the manufacturer's manual, including, but not
limited
to, fully
extending the axles; and
2. Enforce the procedures described in the manufacturer's manual for the
safe operation of the
110HX JLG aerial lift.
NOTE: Because abatement of this violation is already documented in the
inspection case
file, the employer need not submit certification or documentation of
abatement for this
violation as normally required by 29 CFR 1903.19.
