Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a hazard of an elevator failing in that the employees were
exposed to the
elevator failing during operation due to the lack of an inspection by an
enforcing authority:
a)Job Site: Employees were exposed to potential hazards from an elevator
that was
not inspected in accordance with the Handbook on A17.1 Safety Code for
Elevators and Escalators, ASME A 17.1-1993, Rule 1000.2. R-2-R Construction
Corp., employees used the elevator daily to transport tools, equipment and
personnel to the upper floors. The elevator was not inspected by an
enforcing
authority prior to use, on or about 07/12/05.
Among other methods, one feasible means of abatement to correct this
hazard is to follow
guidelines outlined in the Handbook on A 17.1 Safety Code for Elevators
and Escalators, ASME
A 17.1-1993, Rule 1000.2,"Applicability of Inspection and Test
Requirements", that requires
an acceptance inspection and test to be performed before the equipment is
turned over for
service.
NOTE: The employer is required to submit abatement certification for this
item in
accordance with 29 CFR 1903.19.

the elevator platform
which was not enclosed on the sides and top:
a)Job Site: The elevator platform on which the employees were riding was
not
enclosed on the sides and top, thus exposing the employees to crushing &
fall
hazards, on or about 07/12/05.
Among other methods, one feasible means of abatement to correct this
hazard is to fully
enclosed on all nonentrance sides and top, as outlined in the Safety Code
for Existing Elevators
and Escalators, ASME A 17.3-1996 section 3.4.1.
NOTE: Because abatement of this violation is already documented in the
inspection case
file, the employer need not submit certification or documentation of
abatement for this
violation as normally required by 29 CFR 1903.19.

were exposed to falling down the elevator shaft or being crushed by a
moving elevator:
a)Job Site 1st through 5th Floors: The elevator hoistway doors were not
installed
on all hoistway entrances, thus exposing the employees to a fall hazard or
being
crushed by a moving elevator, on or about 07/12/05.
Among other methods, one feasible means of abatement to correct this
hazard is to follow
guidelines outlined in the Safety Code for Existing Elevators and
Escalators, ASME A 17.3-
1996, Section 2.6.1 Doors or Gates Required which states in Section
2.6.1(a) Passenger
Elevators. Hoistway-landing openings for passenger elevators shall be
provided with entrances
which guard the full width and height of the openings."
NOTE: Because abatement of this violation is already documented in the
inspection case
file, the employer need not submit certification or documentation of
abatement for this
violation as normally required by 29 CFR 1903.19.
