Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) On or about May 20, 2004, at the jobsite located at 2423 Kennicott in Arlington Heights, Illinois, an employee working on the roof operating a Garlock hand powered material hoist was exposed to injuries due to improper use of counterweights. The proper usage of the material hoist requires that permanent counterweights be used. This information is provided by the manufacturer in the instructions. A feasible and useful means of abatement includes, but is not limited to the following action: 1. Attach permanent counterweights to the hand powered material hoist. No abatement certification or documentation is required for this item.
