Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of falling:
a) On or about April 12, 2004, at ABC COKE Birmingham, AL an employee was
leveling the load of COKE on top of the Tractor Trailer Dump Truck 14 feet
high
without fall protection.
Among other methods, one feasible and acceptable method to correct this
hazard:
(a) is not to allow employees to climb on top of the dump trailer without
a fall protection
system in place.
(b) is to use a modified rake to level the COKE from the ground without
having to climb
on the top of the trailer.
(c) is to provided a platform with guardrails where the drivers can level
the coke from
the platform and not required to climb on the trailer.
