T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The employer did not ensure that a guard, which was recommended and initially provided by the manufacturer, was in place over the lower controls of the KH-26 bucket truck to prevent accidental actuation of the bucket while occupied. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a guard over lower controls on the bucket truck.
