Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD: a)Maintenance Department, on or about 07/28/04: Overhead hoist used for lifting materials including but not limited to vehicle parts. 1)Hoist was not being inspected on a frequent and periodic basis. 2)Support structure and monorail were not designed and installed by a qualified person. 3)Hoist system was not load tested prior to use. 4)Safety clip on load hook was missing. ABATEMENT NOTES: Among other methods, several feasible methods of abatement are to: 1.Conduct frequent and periodic inspections of the electric hoist for wear, deterioration and malfunction as per ASME B30.16.1987. 2.Request a qualified person to inspect the support structure for the hoist system as per ASME B30.16-1987. 3.Load test the hoist system as per ASME B30.16-1987. 4.Install a safety clip on the hook. Abatement certification must be submitted for this item.
