Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck against hazards from a lack of seat belt usage: a)On or about 9/8/04, Mann Library: A Scat Trac Skid Steer loader was being operated without the use of a seat belt. Among other methods, several feasible and acceptable abatement methods to correct the hazard is to: 1)Ensure that there is an operable seat belt as per SAE (Society of Automotive Engineers) J1388, Personnel Protection - Skid Steer Loaders, section 5.1. 2)Ensure that employees use seat belts as per SAE (Society of Automotive Engineers) J1388, Personnel Protection - Skid Steer Loaders, section 7.1. 3) Ensure that employees use seat belts as per EMI (Equipment Manufacturers Institute) Skid Steer Loader Manual, pages 9 and 10.
