Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crane failure as the spreader bars are not rated with the equipment capacity: A.) On or about 8-13-04, employees at the pipe machines are exposed to crushing hazards as the spreader bars in use have not been proof tested to demonstrate the equipment capacity. One feasible means of abatement is to have the spreader bars proof tested.r
