Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck by / caught between hazards, while operating a
forklift without wearing
a seatbelt, on or about 05/09/05.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS:
1. Educate each forklift operator during initial and refresher training,
on
the importance of
wearing a seatbelt, when operating a powered industrial truck, as required
by ANSI B56.1,
Section 5.3.19.
2. Enforce the seatbelt policy through frequent and regular inspections of
the workplace.
3. Ensure that seatbelt use is included in the operator's evaluation prior
to receiving certification
to operate the powered industrial truck.
4. Obtain a copy of ANSI B56.1, 1988 and review the safety related work
practices applicable
to the powered industrial truck operated in your facility.
