Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a struck-by hazards resulting from a forklift overturning.
On or about 01/09/06, at 1200 Mason Dixon Lane, Conley, GA:
a) Employee was exposed to a struck-by hazard. Employee was not wearing
the provided safety
equipment (seat belt) while operating the Yale electric forklift unloading
a trailer at the loading
dock.
"AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT
METHOD TO CORRECT THIS HAZARD IS":
Require and enforce operators to use seatbelts while operating forklifts.
No abatement certification or documentation is required for this item.
