Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and caught between hazards in the event of a forklift tipover: (a)An employee was operating a Hyster 50 forklift without the use of a restraint system (seatbelt) on or about May 17, 2006. One feasible and acceptable method in correcting this problem would be to enforce the use of seatbelts as required by ASME B56.1-1993, Safety Standard for Low Lift and High Lift Trucks. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
