General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that not assuring the use of proper parts of equipment for vehicle towing. Orange groves at McLure Rd. in Avon Park, FL. An employee seated in a loaded semi- trailer's cab was struck-by a shackle which was attached to a synthetic towing sling which was being pulled by a "goat" truck. The pin in the shackle did not correctly match the size of the shackle opening and failed during the pulling, on or about May 6, 2004. One feasible and useful method of abatement would be to use a properly sized "wrecker" equipped with a winch and appropriately sized and maintained towing lines and hardware.d
