Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a)International Paper-Riverdale Mill - Gate 4: The employer failed to require drivers to engage the parking brakes on the trucks prior to exiting. One feasible abatement method is to require all drivers to engage the parking brake prior to exiting the truck as required by 49 CFR Part 392.7 and to enforce this as part of the companies safety and health program.
