Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing injury: #1 Kiln Room - On or about 08/08/04, an employee sustained head injuries when he was caught between the horizontal steel beam and the setters and shelves while riding on the kiln cart. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a portable platform to position on the south side of the beam to observe the in and out movement of the kiln cart.
