Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing, or were likely to cause, death or serious physical harm to employees in that employees were exposed to being crushed by the equipment in the event that the equipment would tip over while being loaded onto the lowboy truck: a)An employee was not wearing the seat belt while loading the CAT 320 CL Excavator onto the lowboy truck. ABATEMENT NOTE: One feasible and acceptable way to correct this hazard would be to require and ensure that all operators use the seat belt and are trained to use seat belts while operating the equipment. The Caterpillar Operators Manual, under the Safety section "Before Operating", addresses the need to fasten seat belts.
