Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)The seatbelt was not used while operating the #31294 all terrain
forklift.  The forklift
was used to move materials from the street to the construction site.
ABATEMENT NOTE:
Among other methods, one feasible and acceptable method to correct this
hazard is to ensure
seatbelts are being used as required by the operator's manual under USE of
Seatbelts: Always
wear seatbelt while operating the machine to reduce the risk of personal
injuries, and the
consensus standard ASME B56.6-2002, section 6.2.1(a): Before starting to
operate the rough
terrain forklift truck, be in operating position and fasten seatbelt if so
equipped.
