Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: a.At the worksite where an employee was installing sewer lines, the bucket of the Ford 555D Backhoe/Loader was used as a personnel carrier thereby exposing the employee to a fall hazard. Among other methods, feasible and acceptable abatement methods to correct this include, but are not limited to the following: b.Follow the EMI (Equipment Manufacturers Institute) protocol and safe operating procedure for operators and mechanics which states: Never use bucket for a work platform or personnel carrier.l
