North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: [Reference American National Standard ANSI A92.2-1979, Section 6.3.1.3]: a)retraction of ariel ladder - inspections on ariel ladder serial # 55-3436-90 revealed damaged rollers and worn sprockets and the ariel ladder was continually used without correcting the deficiencies. Among other methods, one feasible and acceptable method to correct this hazard is to have a qualified repairman correct and certify that each of the deficient items are corrected before allowing employees to operate the ariel ladder.
