North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall due to the malfunction of the hydraulic system of a boom lift: a)company location-the hydraulic system of an articulated boom lift mounted on a 1990 International truck, was not inspected on a regular basis. (Ref para 8.2.3(3) ANSI/SIA A92.2-2001) One feasible means of abatement is to institute an inspection checklist in conjunction with the operators manual for the lifting device and the referenced ANSI/SIA standard.
