North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tip over of a crane due to broken or rotten cribbing (ref para 5-3.4.6 ASME B30.5 1994: a)site-cribbing and shoring for a Tadano TR-250 E mobile crane was broken, rotted, not level, and underwater on soft ground and presented a tip over hazard (ref para 5-3.4.6. ASME B30.5 1994).

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by a dropped load due to an un-inspected sling: a)site-two leg wire rope sling attached to the hook of a Tando T-250E hydraulic crane was not inspected prior to use and there was no record of an inspection being done on this particular sling. (ref: para 9-2.8.2 ASME B30.9-1996).
