North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tip-over of a crane due to broken or rotted cribbing and shoring (ref para 5-3.4.6 ASME B30.5-1994): a)site-cribbing or shoring for a Tando TR-250E mobile crane was broken, rotted, not level, and underwater on soft ground and presented a tip over hazard (Ref: Para 5-3.4.6 ASME B30.5- 1994) One feasible means of abatement is to ensure proper and sufficient cribbing and shoring is used in accordance with the appropriate above reference.
