North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling from a moving vehicle (ref. ANSI Z245.1-1992, Mobile Refuse Collection and Compaction Equipment - Safety Requirements): a)various locations in Fuquay Varina - employees who operate automatic loader trash trucks such as 2000 chevy, 1999 GMC, 1992 International and 1989 Ford F100 Diamond Back Tipper were not provided with training and instructions on the safe operating procedures for the trucks and the requirements of the ANSI Standard (ANSI Z245.1-1992, 6.1(a)), including the requirements for vehicles with riding steps (ANSI Z245.1-1992, 6.2.4). ONE FEASIBLE AND ACCEPTABLE MEANS OF ABATEMENT WOULD BE TO DEVELOP A PROGRAM FOR THE CARE AND OPERATION OF THE TRUCKS, WHICH WOULD INCLUDE STANDARD OPERATING PROCEDURES COVERING TRAINING OF EMPLOYEES, SAFE AND ACCEPTABLE PROCEDURES FOR USE (USING THE ANSI STD. AS A GUIDE) AND A SCHEDULE OF INSPECTIONS AND MAINTENANCE (AS NEEDED).NCE
