North Carolina General Statute 95-129(1) of the Occupational Safety
and Health Act of North Carolina:  The employer did not furnish
employment and a place of employment which were free from
recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed
to the hazard of falling from a traveling backhoe.
a) jobsite, Airport Rd.- On 7/20/04, an employee was
observed riding on the fender of a Caterpillar 416C
backhoe while traveling down Airport Rd. to another area
of the jobsite.  The employee was sitting on the fender
of the left side of the backhoe without a seat or
seatbelt.
ABATEMENT NOTE: Among other methods, one feasible method
to reduce this hazard is to follow the owner's manual
which states "Do not allow riders on the machine unless
the machine has an additional seat and additional seat
belt."onal
