Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to multiple injuries from a falling hazard when
employees are
elevated on a pallet used as a platform on the forks of a powered
industrial truck, and the
platform was not secured to the forks and was not provided with guardrails.
a)Topp Business Solutions, Warehouse: the employer allowed employees to be
elevated to
heights in excess  of 20 feet while standing on a wooden pallet that was
not secured to the
forks of the Raymond Model no. 31 stand up fork lift, on or about December
2004.
Among other methods, one feasible and acceptable abatement method to
correct this hazard:
A Lifting platform, designed and approved for such use, shall be secured
to the forks of the
industrial truck as per American National Standards Institute safety
standard for Low lift and
High Lift trucks, ANSI/ASME B56.1-2000, Section 4.17.3(b), or employees
shall use a
scissors lift or other appropriate working platform.

exposed to: falls when climbing storage racks.
a)Topp Business Solutions, Warehouse: employees were required to climb
steel racks to retrieve
products from the middle and top shelves, at a height of approximately 18
feet above the ground,
with no fall protection provided, on or about December 2004.
Among other methods, one feasible and useful method to correct the hazard
- A stair tower,
rolling ladder or portable ladder to gain access to the shelves should be
used.
However a lifting
platform designed and approved for such use, and secured to the powered
industrial truck as per
American National Standards Institute safety standard for Low lift and
High Lift
trucks,ANSI/ASME B56.1-2000, Section 4.17.3(b), could also be used.
