Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to struck by hazards:
a) Truck unloading area: Means were not provided on the Cleveland overhead
(underhung) Tramrail crane system to restrain the track against damaging
lateral and
longitudinal movement, on or about September 30, 2005.
b) Truck unloading area: The Cleveland overhead (underhung) crane system
was
modified without the supporting structure being analyzed by a qualified
person or
manufacturer of the equipment to determine if the structural components
were capable
of supporting additional loads, on or about September 30, 2005.
c) Truck unloading area: The employer did not conduct a thorough periodic
inspection
of the Cleveland and Deshazo crane and hoist systems in that critical
structural
components were not thoroughly inspected, on or about September 30, 2005.
d) Truck unloading area: The employer did not maintain complete and
thorough dated
inspection reports and records for the Cleveland and Deshazo crane and
hoist systems
to provide the basis for a continuing evaluation of the system, on or
about September
30, 2005.
ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
ABATEMENT NOTE: Among other methods, one feasible and acceptable method to
abate
these hazards is to comply with ASME B30.11-2004.
