Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards created by the potential for the unintended operation of a Niagara press brake from falling or moving objects or by accidental stepping onto the pedal as observed on April 27, 2006. OR IN THE ALTERNATIVE 29 CFR 1910.212.(a)(1): a) In the fabrication area the foot treadle on a Niagara press brake was not protected from unintentional actuation by the installation of a guard as observed on April 27, 2006. ABATEMENT OBSERVED DURING INSPECTION NO CERTIFICATION REQUIREDATION
