Section 6(a) of Puerto Rico Occupational Safety and Health Act: The
employer did not furnish
employment which were free from recognized hazards that are causing or
physical harm to
employees were exposed to:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
At the Carimed Plaza construction project located at Bayamon; the
employees were in
the final assembling part of a tower crane, model 1660 TCK, serial number
13337,
trademark FM GRU, maximum capacity 8 MT, at 130 feet height.At the moment
of
installing the cable in the final side of the shore, the employer
permitted
that one
employee that was not trained and qualified to operate the crane took the
controls. Two
employees were in the trolley and one was in the controls of the crane.
The trolley was
moving to the final side of shore, at the same time that the hoist was
climbing. The
pateca was entangled, the operator without experience and without
training, continued
the movement to the front and this generated pressure provoked that the
trolley raised
and strike against the cab, finally caused the death to one employee and
injured another
one. According ANSI B30.3, in the sections 3.3.1.1 y 3.3.1.2, established
that the crane
have to be operated only by designated operators, learners under the
direct supervision
of a designated operator, maintenance operator or inspectors. The
operators shall
approved an oral,  write and practical examination to the specific
equipment. Also in the
manufacturer manual, in the sections: 2-1, 3-15 (# 29) and 16, established
that only
qualified person shall with this.
Hazard: Equipment inadequate handling by lack of knowledge of equipment
operation.
Among others method, one feasible and acceptable was training the
employees in
operating this type of crane.
En el proyecto de construccion Carimed Plaza localizado en Bayamon; los
empleados
estaban en la parte final del ensamblaje de una grua "tower crane", modelo
1660 TCK,
numero de serie 13337, marca FM GRU, capacidad maxima 8MT, a 130 pies de
altura.
Dos empleados se encontraban en el "trolley" y uno manejando la grua. El
"trolley" se
fue moviendo hacia el extremo del puntal, a la misma vez que la pateca iba
subiendo.
La pateca se enredo y el operador como no tenia experiencia ni
adiestramiento, continuo
el movimiento hacia el frente y hubo mucha presion ocasionando que el
"trolley"se
levantara y chocara contra la cabina,  con el saldo de un empleado muerto
y otro
seriamente lesionado.Al momento de instalar el cable en el extremo opuesto
del puntal,
se permitio que una persona que no estaba adiestrada y cualificada para
manejar la grua
tomara los controles de la misma. De acuerdo al ANSI B30.3, en las
secciones 3.3.1.1
y 3.3.1.2, se establece que esta grua debe ser operada solamemente por
operadores
designados,aprendices bajo la supervision directa de un operador
designado, personal demantenimiento cuando fuese necesario e inspectores.
Los operadores deben aprobar un
examen oral y escrito y un examen practico, para equipo especifico.
Tambien en el
manual del manufacturero en las secciones: 2-1, 3-15( # 29) y 16 se
establece que
solamente personal calificado debe trabajar en esta grua.
Riesgo: Manejo inadecuado por desconocimiento en la operacion de este tipo
de grua.
Entre otros metodos, uno accesible y aceptable es adiestrar a los
empleados en la
operacion de este tipo de grua.
