Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: At Cervantes Street #9 located at Condado San Juan, an employee of the San Juan Municipality, died when he was trapped by the rear tires of a garbage paker truck Chevrolet license plate MU-8255. The employer did not trained the employee in the recognition of unsafe conditions and the safe use of the equipment and did not established a periodic inspection program to detect physical or mechanical defects on the equipment prior to its use as established by the ANSI Z-245.1-1992 section 6 Operational requirements. The employee was on the truck right riding step, when the support of it brokes and the employee fell under the truck rear tires. Hazard: Equipment unsafe conditions. A feasible and aceptable abatement method, among others to correct the hazard can be provide a training and education program for the employees prior to assignment to working with this type of equipment and established an inspection program who adress the requirements established by the ANSI Z-245.1-1992 section 6 Operational requirements. En la Calle Cervantes #9 localizada en el Condado San Juan, un empleado del municipio de San Juan, murio cuando este quedo atrapado por las gomas traseras de un camion de recogido de basura marca Chevrolet tablilla MU-8255. El patrono no adiestro al empleado en el reconocimiento de condiciones inseguras y el uso apropiado del equipo y no establecio un programa periodico de inspecciones para detectar danos fisicos o mecanicos en el equipo antes de su uso como se establece en el ANSI 245.1-1992 seccion 6 requisitos operacionales. El empleado estaba montado en el estribo trasero derecho del camion, cuando el soporte de este se rompio y el empleado cayo debajo de las gomas traseras del camion. Riesgo: Condiciones inseguras del equipo. Un metodo factible y aceptable entre otros metodos que se pueden utilizar para corregir el riesgo existente es proveer un programa de educacion y adiestramiento a los empleados antes de asignar los trabajos con este tipo de equipos y establecer un programa de inspecciones el cual cumpla con los requerimientos establecidos en el ANSI Z245.1-1992, seccion 6 Requerimientos de operacion.ntos
