Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:

El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
At the construction project The Coliseum Tower Residences; the employees
were
removing the molds in the twenty floor of the building. In the moment in
which the crane
was lifting up one of the parts that was placed over the two metal
rollers, each one of
31 pounds, this is to facilitate its movement out of the building. The
roller
that was close
to the floor's edge got loose and fell over the ceiling of the personnel
hoist, brand
"Stros", without model, serial number 2332 UPPR at the height of the eight
floor. The
roller penetrated the wooden ceiling of the personnel hoist and struck the
employee head
that was operating the equipment, causing his death. In accordance with
the Scaffolding,
Shoring & Forming Institute, Inc. the employer has to follow the
recommended
procedures by the manufacturer, verify before and during any lifting of
the parts, assure
that there are no loose or ungarded parts which could fall and become
dangerous
projectiles. Make sure no people are around in where the lifting of parts
is taking place.
In accordance with the manufacturer's manual ("Symons"), the employer
should prepare
a sketch or diagram of the works to be done.
Hazard: Struck due to loosen parts.
Among other feasible and acceptable methods of correction, are training
the employees
in ways of adecuate removal and lifting of the molds, secure the loose
parts or none
secure efficiently enough during the lifting. This is to avoid for the
parts to get loose and
become dangerous projectiles in case of falling. Finally implement a safe
and efficient
communication system to avoid for people to be underneath or near where
the rollers are
being lift up.
En el proyecto de construccion "The Coliseum Tower Residences"; los
empleados se
encontraban removiendo las voladoras en piso 24 del edificio. En el
momento en que la
grua estaba levantando una de las piezas que estaba colocada encima de dos
rolillos de
metal de 31 lbs. cada uno cuyo proposito era facilitar su movimiento, para
sacarla fuera
del edificio; el rolillo proximo al borde del piso se safo y cayo sobre el
techo del
montapersonal marca "Stros", sin modelo, numero de serie 2332 UPPR, a la
altura
del
octavo piso. El rolillo traspaso el techo de madera del montapersonal y
cayo sobre la
cabeza del empleado que estaba operando el equipo, resultando muerto el
empleado. De
acuerdo a recomendaciones del "Scaffolding, Shoring & Forming Institute,
Inc."; el
patrono tiene que seguir los procedimientos recomendados por el
manufacturero, tiene
que verificar antes y durante los levantamientos de las voladoras que no
haya piezas
sueltas o no aseguradas que puedan caer durante el proceso y convertirse
en proyectilespeligrosos y asegurarse de que no haya personas en los
alrededores donde se estan
levantando las piezas. Y de acuerdo al manual del manufacturero
("Symons"), el patrono
debe preparar un plano de los trabajos a ser realizados.
Riesgo: Golpes por desprendimientos de piezas.
Entre otros metodos de correccion, unos accesibles y aceptables son
adiestrar a los
empleados en la remocion y levantamiento adecuado de las voladoras,
asegurar
las piezas
sueltas o no aseguradas eficientemente como en el caso de los rolillos
para evitar que
cuando ocurra el levantamiento de las piezas estos se safen y caigan como
proyectiles
peligrosos y finalmente tener un sistema de comunicacion seguro y
eficiente para evitar
que haya personas debajo o en los alrededores de donde se estan levantando
las
voladoras.
